Scope
These SMS and Communications Terms apply to text messages, phone calls, emails, in-app messages, support replies, workflow reminders, compliance notices, account alerts, marketing messages, and similar communications sent through or about SmartComply.
Some communications are sent by SmartComply directly. Others may be sent by customers using SmartComply workflows to communicate with regulated entities, testers, haulers, industrial users, food service establishments, property owners, employees, contractors, or other participants.
Consent to text messages
If you provide a phone number and opt in to text messages, SmartComply or a SmartComply customer may send operational, support, reminder, verification, workflow, or compliance-related messages to that number.
Consent is not required to buy SmartComply. Message frequency varies by workflow, customer configuration, and user activity. Message and data rates may apply.
Types of messages
Messages may include account verification, login or security notices, support updates, demo or sales follow-up, product notices, deadline reminders, overdue notices, test reminders, inspection scheduling, manifest reminders, compliance status updates, and other workflow-related communications.
Marketing messages, if used, will be sent only where permitted and will include required opt-out instructions.
Opt out and help
When supported, you may reply STOP to opt out of text messages from the sending program and HELP for assistance. Opt-out wording may vary depending on the messaging provider and customer configuration.
You may also contact the customer that sent the workflow message or contact SmartComply support at support@smartcomply.app.
Opting out of optional texts may not stop legally required notices, emails, in-app alerts, security messages, or customer communications sent through other channels.
Customer responsibilities
Customers are responsible for obtaining any required consents, honoring opt-outs, configuring message templates accurately, identifying themselves as the sender where required, and complying with TCPA, CAN-SPAM, public records, procurement, environmental, and other applicable communications laws.
Customers should not use SmartComply messaging to send spam, deceptive messages, unrelated marketing, emergency 911 communications, or messages outside the scope of their program.
Delivery not guaranteed
Carriers, email providers, spam filters, device settings, network conditions, and third-party services may delay or block messages. SmartComply does not guarantee that any particular message will be delivered, read, or acted on.
Customers should not rely on SMS or email alone where law, permit conditions, enforcement procedures, or safety considerations require another form of notice.
